

Federal and state laws require that tax-exempt organizations file an annual return. Depending on the financial activity, it can be any of the following: IRS Form 990 (990, 990EZ or 990N)

Even if your status is "inactive" you must file with the IRS.

Deadline for filing is four and one-half (4 1/2) months after the end of a PTAs or PTSAs fiscal year.

If your gross receipts are less thank $50,000 you should file the Form 990-N (e-Post card). This is an easy form to complete. For instructions please click here.

Remember to print the confirmation page confirming the 990 has been filed. You will need it for the following;

Please provide a copy of the page to the president and secretary at the next board meeting.

Retain a copy for the treasurer's files.

Complete the online Texas PTA Annual Tax-Exempt Confirmation Form, click here. This is required by Texas PTA. This needs to be submitted as soon as you file Form 990.

At the next PTA/PTSA general meeting, the treasurer should inform the members that the 990 has been filed and the board has a copy of the confirmation sheet.
Texas PTA Ethics/Conflicts of Interest Policy

IRS requires that all board members of tax-exempt organizations sign a conflict of interest policy each year. Texas PTA also requires this. For your convenience, the Texas PTA Ethics/Conflicts of Interest Policy is available in English and Spanish. Failing to File

Failure to file a Form 990 for three consecutive will result in the IRS automatically revoking a PTA's tax-exempt status. Getting tax-exempt status reinstated involves considerable paperwork and fees of $400 or more. Don't let this happen to your PTA/PTSA!

Bylaws Request
Don't know when your fiscal year is and need a copy of your bylaws?

Only a PTA officer on record at Texas PTA, may request a copy of the bylaws and will be returned to the person requesting the copy.

Bylaws will be sent on the updated template with an approval stamp date when last reviewed and approved by Texas PTA.

Due to the heavy volume of requests for copies of bylaws, Texas PTA informs that it can take up to 4 weeks for processing.
